Lawmaker José Pereira Coutinho wants to know why Chief Executive Fernando Chui Sai On did not allow the former Chief Executive Edmund Ho Hau Wah to testify in court in the fifth case related to the ex-secretary Ao Man Long corruption scandal.
Article 5 of law 22/2009 states that a former Chief Executive – as well as other high ranking officials – “cannot be inquired as witnesses, experts or deponents, in criminal procedures”, about “confidential or reserved facts they came to know about while on duty”, unless they previously obtain the Chief Executive’s permission for that.
However, Coutinho argued in the written query sent to the Government that Pedro Chiang’s attorney João Miguel Barros has said that he is not going to ask Ho about issues regarding confidential or reserved facts.
The lawmaker believes that the Chief Executive had no reason to reject Barros’ request. Thus, he asked the Government to “clearly”explain the legal reasons that drove the Chief Executive to prevent the former Chief Executive from testifying as a witness in the process.
